SEE: Dros Rape Accused Claims Police Brutality

Tensions outside court ran high as the 20-year-old man accused of raping a 6-year-old girl in the restrooms of the Dros restaurant in Pretoria made an appearance in court this morning (2 October 2018).

Prior to addressing the matter on the merits, the court dealt with an application to allow photographs taken of the accused in court to be published. The application was granted by Magistrate Mokoena.


The State then applied for the matter to be postponed to facilitate further investigation, and that the accused be remanded into custody. They also requested that he hand over his cellphone to assist investigators. On behalf of the defence, Riaan Du Plessis objected to the States request that the suspect hands over his cell phone. “Your honour my client doesn’t want to help the state with its case,” he said. He also detailed injuries the accused had sustained. The first injury is on his earlobe (approximately four stitches, said du Plessis, and it was alleged that he was injured with a broken bottle at the scene of the arrest. Du Plessis also said the accused has two cuts on his head from a broken bottle as well. He also has a cut on the right side of his neck.

The defence is also alleging police misconduct. Du Plessis told the court that at the accused’s first appearance, both his eyes were blue. He went on to say that the ‘Silverton police asked him to do push ups and also kicked him’.


The case has been postponed to the 1st of November for further investigations.
